驚世媳婦林于如想逃死刑　聲請釋憲失敗

南投涉嫌接連殺害母親、婆婆和丈夫3條人命的「驚世媳婦」林于如，最高法院６月時判處死刑定讞，林于如為逃過死刑，認為判決適用刑法第19條，違反《兩公約》、《憲法》，因此聲請釋憲。大法官會議今天決議不受理。

被稱為「驚世媳婦」的林于如(32歲)，原和劉姓丈夫在南投縣埔里鎮經營臭豆腐的批發生意，家境還算富裕。但她在08年間，開始沉迷於六合彩簽賭，因積欠賭債，於是展開了殺母、殺夫、殺婆婆以詐領保險金的殺人計畫。

林于如為逃過死刑，以判決適用《刑法》第19條「精障或心智缺陷，導致欠缺辨識能力者不罰或減刑」，違反《兩公約》「心智障礙者，不問障礙程度，均不得判處死刑」、《憲法》保障人民生存權的規定，因此聲請釋憲。

但大法官會議決議認為，林于如聲請釋憲，本案判決並沒有適用《刑法》第19條，不符合大法官審理的規定，因此不能聲請釋憲。
