【黃哲民／新北報導】62歲黃姓婦人經營網拍販賣隱形胸罩，去年因在商品網頁使用「NUBRA」字樣，被握有「NuBra」商標權的絕世好波公司控告涉犯詐欺取財與《商標法》罪嫌。

絕世好波公司並舉出2007年一份案情類似的刑事判決，佐證該案被告因使用「NUBRA」字樣被判處緩刑。

黃婦辯稱使用「NUBRA」一字代表隱形胸罩商品，並非盜用絕世好波公司的商標，且商品頁面均顯著標示自家公司品牌「方妮FaNi」商標圖文，得知發生爭議後，已撤除商品頁面的「NUBRA」字樣。

新北地檢署認為時空背景改變，現今消費者應能分辨「NUBRA」代表隱形胸罩商品，不會因此混淆商品是否來自絕世好波公司，將黃婦與方姓助理均不起訴。
