買東門九如生意差 拒付尾款

鍾姓男子3年前花了1500萬元，買下台北市年菜名店「東門九如」，但鍾男因認為營業額不佳、未獲得賣家完整的烹飪配方，拒付尾款300萬元，遭原經營者興訴索討，高院昨判決鍾男敗訴，須給付款項，全案可上訴。

有40多年歷史的台北市「東門九如」商號，在金山南路以湯圓、粽子等江浙點心聞名，與便利超商合作推出年菜預購，年營業額逾千萬，但新經營者接手後，因營運不佳目前已暫停營業。

提起訴訟的賴姓女子指出，鍾男透過朋友介紹表示願以1500萬元買下店內所屬設備，店內銷售商品及烹調技術，鍾付款1300萬元後，賴母還到店內半年進行指導，沒想到事後鍾卻以各種理由拒付尾款，她因此打官司索討。

鍾辯稱，當初賴稱「東門九如」年營業額上看千萬，但接手後僅500多萬元，而且賴女也沒有將店內所有商品配方完整交付給他，因賴沒有依契約履行，所以不須再付尾款。

高院審理後，傳喚店內廚師作證，認定賴婦確實有傳授烹飪功夫，且有問必答，再加上買賣合約內沒有提到「保證營收」，因此認定鍾男沒有理由拒付尾款，判鍾男敗訴。
